1.Nature of our business

We hire and lease vans, plant and machinery to businesses and individuals on short-term and longer-term arrangements. Ownership of the equipment remains with us throughout; we do not sell equipment on hire purchase, and we do not offer arrangements under which title passes to the customer at the end of the term.

All hires are supplied on our published Terms of Service, together with any signed hire agreement for the specific hire.

2.Regulatory status

Operating leases and simple equipment hire of the kind we provide are not, in themselves, regulated activities under the Financial Services and Markets Act 2000.

Where an arrangement would amount to regulated credit or regulated hire, we will say so before you enter into it and will only proceed where we are properly permitted to do so, or through an appropriately authorised third party.

3.Consumer credit and consumer hire

Hire agreements with individuals that can last more than three months may fall within the consumer hire provisions of the Consumer Credit Act 1974. Where that applies, you will receive the pre-contract information and the cancellation rights the Act requires, and the agreement will set out the charges, the term and how it may be ended.

We do not provide credit, and we do not act as a credit broker. We do not receive commission for introducing customers to finance providers.

4.Insurance

We hold the insurance appropriate to our activities, including employers’ liability cover as required by the Employers’ Liability (Compulsory Insurance) Act 1969, and public liability cover.

Our insurance covers our own operations. It does not cover the equipment while it is in your possession, nor your use of it. As set out in our Terms of Service, risk passes to you for the duration of the hire and you are responsible for insuring the equipment for its full replacement value and for third-party liability. Evidence of that cover may be requested before equipment is released.

5.Complaints

If something has gone wrong, tell us. Email info@pinewoodleaseandhire.com with the details, the hire reference if you have one, and what you would like us to do to put it right.

We will acknowledge your complaint within three working days and give you a full written response within eight weeks, or explain why we need longer. Complaints are handled by someone not directly involved in the matter wherever that is practical.

If you are not satisfied with our final response and you are a consumer, you may be able to take the matter to an alternative dispute resolution provider or to the courts. Nothing in our complaints procedure affects your statutory rights.

6.Data protection

We process personal information in accordance with the UK GDPR and the Data Protection Act 2018. Full detail of what we collect and why is in our Privacy Policy.

You have the right to complain to the Information Commissioner’s Office about how we handle your personal information, at ico.org.uk.

7.Health, safety and roadworthiness

Equipment is inspected, serviced and, where applicable, thoroughly examined in line with the manufacturer’s schedule and the Provision and Use of Work Equipment Regulations 1998 and the Lifting Operations and Lifting Equipment Regulations 1998. Vehicles are maintained and, where required, hold a current MOT certificate.

Records of inspection and maintenance are kept and are available to hirers on request. Once equipment is on hire, responsibility for safe use, daily checks and site risk assessment rests with the hirer.

8.Environmental compliance

Waste oils, filters, batteries, tyres and other hazardous materials arising from servicing are transferred only to licensed carriers, and duty-of-care transfer notes are retained. End-of-life vehicles are disposed of through authorised treatment facilities.

9.Modern slavery, bribery and tax

We do not tolerate slavery or human trafficking in our business or supply chain, and we expect the same of our suppliers. Our turnover is below the threshold at which section 54 of the Modern Slavery Act 2015 requires a published statement.

We prohibit bribery and the facilitation of tax evasion by anyone acting for us, in line with the Bribery Act 2010 and the Criminal Finances Act 2017, and we meet our obligations to HM Revenue & Customs in full.
